Key Bay to arrive in France while complaints to be filed

On 20 January at 5 PM, the vessel Key Bay is set to arrive in the north of France. Polisario is filing complaints vis-a-vis French and EU authorities, asking them to act.

In only two days from now, at around 5PM in the afternoon of 20 January, the chemical tanker Key Bay will arrive in Normandy, France, with a cargo from occupied Western Sahara. The vessel was last registered to the west of Portugal, in the early afternoon of 17 January.

The vessel contains fish oil from occupied Western Sahara, a consignment it picked up on 6-7 January in El Aaiun. Based on years of observing the fish oil shipments, WSRW presumes the importer to be the French fish oil supplier Olvéa.

It is the first known shipment of fish oil into the EU after the judgement of the Court of Justice of the EU of 21 December 2016, concluding that no EU Trade Agreement with Morocco can be applied to the territory without the prior consent of the Sahrawi people since Morocco has no sovereignty over the territory of Western Sahara.

The arrival of the Key Bay into the Union thus presents a test-case to verify whether the EU institutions are ready to implement the judgment by the EU Court of Justice. Spanish police and harbour authorities already boarded the vessel and proved that the cargo is indeed from Western Sahara, during its short stop-over in Las Palmas.

The national liberation movement of Western Sahara, the Front Polisario, yesterday issued a press release that it is about to send a complaint with the French customs authorities and the EU Commission, to assure the law will be upheld.

"Morocco is the military occupation power obliged to abide by the Geneva Conventions, and has no right to issue export permits", stated Mr. Mhamed Khadad of the Polisario.

"We are hoping for dialogue, but we are determined to see the judgement from the Court of Justice applied", he stated.

On 16 January, three European Parliamentarians of the Greens wrote to the EU High Representative, Ms Mogherini, the EU Trade Commissioner, Ms Malmström, and the EU’s Commission for Economic and Financial Affairs, Mr Moscovici, asking them to seize the French authorities with a view of taking appropriate measures before the Key Bay arrives in the port of Fécamp in order to ensure the enforcement of EU legislation.

Le Front Polisario dépose plainte devant les autorités européennes et françaises pour une application stricte de l’arrêt du 21 décembre 2016

Le Front Polisario suit avec la plus grande attention les conditions dans lesquelles le navire Key Bay, qui a embarqué de l’huile poisson à ElAaiun, sera amené à respecter le droit européen, tel qu’il a été rappelé par l’arrêt de la Cour de justice de l’Union européenne le 21 décembre 2016, décision exécutoire qui doit être pleinement respectée.

Grâce à l’action, sur place, de Pilar Alvarez, adjointe au maire de Las Palmas, et de Florent Marcellesi, parlementaire européen, toutes les informations sont désormais disponibles. Le Key Bay a fait escale à Las Palmas (Espagne) pour faire le plein de fuel, et pendant ce bref laps de temps, la Guardia civil a pu prendre connaissance des documents permettant le transport. Il en ressort que les autorisations ont été établies à ElAaiun, sous occupation marocaine, ce qui établit la violation du droit international. En effet, il y a eu la pêche des poissions dans les eaux sahraouies, puis leur transformation en huile, puis l’embarquement, le tout sous de prétendues autorisations marocaines, avec pour finalité la mise sur le marché européen de produits à destination humaine. Or, de tels produits ne peuvent accéder au marché européen que s’ils sont accompagnés de certificats d’origine et des garanties sanitaires établis par l’administration de l’Etat d’origine.

Dans son arrêt du 21 décembre 2016, la Cour a dit que le Maroc et le Sahara occidental étaient des territoires distincts, relevant de souverainetés distinctes, et que les accords conclus entre l’Union européenne et le Maroc ne pouvaient en aucun cas s’appliquer au Sahara occidental. Ainsi, les produits prétendument marocains mais qui en réalité proviennent des eaux sahraouies et du port de ElAaiun peuvent être exportés par des entreprises européennes et accéder au marché européen qu’avec l’autorisation du Front Polisario, seul représentant du peuple Sahraoui. M. Mhamed Khadad membre de la direction du Front Polisario souligne : « Cela concerne toutes les eaux relevant de la souveraineté sahraouie et toutes les embarcations portuaires depuis ElAaiun. Le Maroc est la puissance militaire occupante, soumise à la IVème convention de Genève, et n’a aucun droit à délivrer des autorisations d’exportations ».

Hier, 16 janvier 2016, des parlementaires européens – Mrs Florent Marcellesi, José Bové et Bodil Valero (Les Verts) - ont officiellement saisi Madame Mogherini, Haute représentante de l’Union européenne, M. Malmstrom, Commissaire européen au commerce et M. Moscovici, Commissaire européen aux affaires économiques et financières, des violations du droit européen qui seraient commises si le Key Bay pouvait procéder au débarquement d’une cargaison provenant des eaux sahraouies et d’un port sahraoui.

M. Mhamed Khadad a annoncé ce 17 janvier que le Front Polisario va, sous 48 heures, déposer plainte auprès de la Commission européenne et des autorités douanières en France afin que soit respecté le droit européen : « Nous espérons le dialogue, mais nous sommes déterminés à faire appliquer l’arrêt de la Cour de Justice ». Selon la feuille de route officiellement publiée, le Key Bay doit arriver à Fécamp en France en fin de cette semaine. Les autorités douanières françaises violeraient le droit européen en admettant le débarquement de produits qui ne sont pas garantis par des certificats d’origine valable, alors le Maroc n’est pas souverain à « ElAaiun».

Le Front Polisario demande à la Commission européenne et aux autorités douanières qu’il soit dressé un procès-verbal du caractère illégal de cette exportation, et que la cargaison soit saisie conformément aux prescriptions du droit douanier européen.
